Terms of Service
The terms governing your use of Nearby Servers and the servers you buy from us.
Who you are contracting with
Nearby Servers is operated by KRP Tech Solutions OPC Private Limited, a company registered in India with a business address in Kelowna, British Columbia. Buying a server or using this website means you accept these terms. If you do not accept them, do not place an order.
What we provide
Virtual servers, dedicated servers, bare metal, Windows RDP desktops, shared web hosting and hourly burst servers, in the locations listed on this site. The specification you order is the specification we supply; anything described as "from" a price is a starting build that you configure upward.
Provisioning
Servers are built by hand rather than dispatched by a script. We do not promise a provisioning time on this website, and you should not rely on one unless we have given you a committed turnaround in writing for a specific order. We email you when the machine is live and the credentials are in your dashboard.
Fees and payment
Fees are billed in the currency shown at checkout, monthly in advance, annually in advance at eleven months for twelve, or hourly for the Burstable class. Subscriptions renew until cancelled. If a payment fails we will contact you before suspending anything, but sustained non-payment ends in suspension and then deletion of the data on the machine.
Your responsibilities
You are responsible for what runs on your server, for keeping its operating system and applications patched on unmanaged plans, for your own backups, and for the security of your credentials. Root access means exactly that: we cannot prevent a configuration you choose from breaking your own service.
Suspension
We may suspend a service that breaches the Acceptable Use Policy, that is being used to attack others, or that we are legally required to suspend. Except where the law or an ongoing attack forces immediate action, we tell you first and give you a chance to fix it.
Data on termination
When a service ends — by your cancellation or ours — the data on it is deleted. Take a copy before the end date. We are not able to recover a machine once it has been reclaimed, so do not treat our infrastructure as your only copy of anything.
Liability
To the maximum extent the law allows, our aggregate liability for any claim is limited to the fees you paid us for the affected service in the three months before the claim arose. We are not liable for lost profit, lost data or consequential loss. Nothing here limits liability that cannot lawfully be limited.
Changes to these terms
We may update these terms; the date at the top of this page changes when we do. Material changes are emailed to account holders before they take effect.
Governing law
These terms are governed by the law of our place of business, without prejudice to consumer protections that apply to you where you live and cannot be contracted out of.
